Unifund Class Action in Progress... Robert Paisola Responds

Hi,

I just read a piece on line regarding this Unified case. Yesterday I check my credit report after getting declined from trying to purchase a large item. Unbeknownst to me, this so called "Unifraud" company dinged my credit report back in Oct.07. I have zero letter correspondences from them stating this account, amount, and where it originated from. I think they bought this from an outstanding Citi account I had, and was unable to pay at the time.

How do I get these creeps off my back, prevent a bogus law suit, and STOP them from dinging my credit? I see lots of news on them company,and have come across some guy named Bud Hubbs. This guy said he was some sort of expert in this area, and turned out to be completely useless.

Please help.

Hi Robert Paisola:
I did a lot of research on google.com and everything pointed to this site. I hope I am not wasting your time
but I had to vent and I didn't know where to turn.
Last week some very large rude man came to my door and handed me three sheets of paper.
As I read it, I was very upset to read that I have to appear in Court on March 17th to face a suit
by UNIFUND CCR PARTNERS for about $6000.00 before lawyers fees, etc...
This charge stems from the year 1998...I paid on this account in good faith until 2004 when all the sudden the balance had skyrocketted. I called and ask how the balance jumped thousands of dollars and not one
person could respond. For years they have been calling me on this card and for years all I have been asking them if for proof of what I OWE for. They always told me that the card was so old and they could not come up with the proof. I sent letters and asked for explanations but never head back until I received this summons to appear in court. When I called the law office in the St Louis area that must be representing
this UNIFUND and asked them what would happen if I didn't appear in court they told me that their
would be a "default in judgement" and they could garnish my wages. Can they do this? I have no problem appearing in court but I work and I just cant take off work at last minute notice.
All I ask is for proof of all these charges they claim I owe and all they can tell me is that I paid through 2004 but they cant give me proof of charges.
I'm very upset and very scared. What should I do?

Another Unifund Lawsuit, Robert Paisola Responds

Hello,

I obtained your contact info from the internet and I think I may need some help. The attached papers were served to me on 01-05-08 by the Pine County sheriff's Department (MN) from Como Law Firm on behalf of Unifund CCR Partners. I am unsure how to reply to the complaint and what my responses should be. I am also wondering if this is an "authentic" document that was actually submitted to the court. My research has led me to believe that this may not be the situation, as there is no case number, time stamp, clerk's signature, etc. on the papers. If it is true that this was not filed with the court, and merely a collection letter, would this be a violation of the Fair Debt Collection Practices Act? My basis for that question is "§ 807. False or misleading representations" under the FDCPA. I have also done a small amount of research on both Como Law firm and Unifund, and discovered that both have been perceived as using questionable business practices/tactics in order to obtain default judgments from uninformed consumers. I definitely do not want to fall victim to them, if that is the case. Another factor on this issue is that this debt may be older than the 6 year statute of limitations allows them to take action on. I cannot accurately verify that at this point, due to my poor record-keeping on this account. I do have two saved credit reports, but I am unable to determine from those when the last action was, since the debt has been sold. With all of this said, I fear that I may not be able to afford the quality of representation that you provide. I am not very well off, and live paycheck-to-paycheck at this point. I do realize that your services demand a fee, and hope that we can agree on a reasonable rate, if we get to that point. Thank you very much for taking the time to read this message. Let me know what additional information you need and what measures I should take next. I am eagerly looking forward to a response from you.

These guys are suing me for a debt that was closed by the original credit several years ago! Can you give me some guidance?

Rob,

My husband is being sued by Unifund. We have done all that we can think of to dispute this bill and today called to try to settle.
They (unifund) and lawyers are insisting that we owe them $19,000, which is not so. They have filed a judgement with the courts and the
time is ticking. What can we do?
