So, you have been abused by American Express or one of their collection agencies. You have gone through all of the normal processes that you can and finally you decide that the only way to get justice is to have your day in court.

I was contacted by Nationwide Credit on Friday April 4, 2008 about a delinquent American Express account. They tried very hard to get me to pay the debt in full or make a large down payment and payment arrangements. I offered to pay them $8500.00 within 5 days to settle the account and that was unacceptable. When I asked for them to send me something in writing, they refused and told me I had to take advantage of their offer that day or my account would “go to audit”. They wanted my bank account information and a date when they could electronically transfer funds from my account. I refused and told them that I needed to research this further and they needed to contact me via phone today, April 7, 2008.

While doing research, I found your website with the recording and transcripts from past dealings with Nationwide Credit.

American Express and Nationwide Credit, We will TAKE YOUR PASSPORT and DEPORT YOU IF YOU DO NOT PAY! by Robert Paisola

Dear Western Capital Financial Team,

I am in a situation and desperately need some input or advice from you guys. Below is my story:

" I am naturalized US citizen and also a citizen of a South American country. A year ago my family ran into some deep financial trouble, so without any concern for my credit, I withdrew some cash advances from my credit card ($10,000 & $18,000) respectively from two credit cards that I had for years and paid them regularly. Before this I had excellent credit. Then I also ran up my Amex cards for $6,000.00, and made a payment or so but I could not afford to pay them any more. I have since moved out of the US and taking care of my family. I do have intentions to pay my debt back but at this point am not able to as my family is suffering and I am barely making ends meet. I am still in touch with my roommate in the US and the other day I happened to get an email from him. He said that someone from Nationwide contacted him regarding my Amex debt, and when my roommate said that he thinks I am out of the country, then the Nationwide rep said that they're pursuing Credit Card Fraud charges against me, and that it is a Federal Case and as soon as I use my passport anywhere I will be arrested and extradited to the USA. And he also went and said that if I don't travel then they will contact all US embassies and my passport won't be renewed or will be confiscated and they will affect my citizenship.

Dear WCF team, please advise me if there is any truth to this. I lived in the Us for 15 years, was a diligent tax payer, a good citizen and never committed any crime..heck, I didn't even get a traffic ticket in 10 years. I know what I did was absolutely wrong but at the time the circumstances were such that I couldn't help it. Now I regret my actions. I thought that my debt would go to collection and my credit would be ruined for 10 years. I really love the US and wish to come back some day when the dust is settled. But this email from my roommate regarding Nationwide's threat has made me sick to my stomach. Please advise me is there is any shred of truth to this, and can my citizenship really be affected by unpaid debt and can I be picked up at an airport and have my passport confiscated".
Please advise me in this matter, as I have lost all my peace and am worried to the point that I haven't slept for days.Any advice would be greatly appreciated.

NCO and American Express, Will they ever be stopped! Posted by Robert Paisola

I am copying an email sent to the executive office of American Express regarding our AMEX Corporate Gold card. We were recently sent to NCO, formerly Risk Management for collection, even though we have continued to pay on the account on a daily basis. I am working with through my attorney to try to deal with these people now. I would like to get your opinion and see if you think you might be able to help us. We have paid the account down from 177K balance to 64K in 6 months.

Mr. Chenault,

I am writing to ask for your help regarding an issue with our Corporate AMEX account #3715 , for Poncini ,,,. I realize you are very busy, but I have tried to contact someone about this issue and I am just running into roadblocks. If you could give me a contact in a position that could help me it would be greatly appreciated. Thank you.

Without going into a ton of details, our credit limit on the account was lowered from approximately 200K to 50K in September of 2007. We used this card for all our day to day business expenses, including inventory, utilities, advertising, etc. With such a severe decrease in our available credit, we had to start using cash to pay for these daily expense while still trying to pay our AMEX account balance, which at the time was 177K.

I run a small, but profitable company, but we were unable to meet our obligation to pay the balance in full and continue to operate our business.

We wanted to work out a payment schedule right away and communicated that with our account rep. She was reluctant to do so stating that it would cancel our account and suggested we just pay as much as we can for the next 90 days and we would see how it looked then.

By December 2007 we had knocked off about 90K of the 177K. Our rep advised us that if we were unable to pay the remainder within the next 30 days our account would be reported to the credit bureaus. I once again requested a payment schedule, but was told that it would be to our benefit to just keep paying.

Last month we agreed to a payment schedule of 8K per month over the next 9 months to cover the remaining balance. We were advised that this would be kept in house and no more late fees would be charged. I continued to pay on a daily basis on the account, about 10K over the last 30 days, but yesterday I received a call from NCO, a collection agency.

The agent informed me that I would be sued and suggested I borrow the money to pay off the debt. If I could borrow the money I would have paid this off months ago. We are struggling like most small companies in this economy right now. I have always intended to meet our financial obligation with AMEX and always communicated our situation and kept paying on an almost daily basis.

I spoke to an AMEX account services rep last night and she stated that AMEX would gladly take the account back from the collector, as there was a miscommunication regarding the payment arrangement we had made. Our rep did not inform us that it was not okay to make multiple payments over the 30 day period, you are required to make 1 single payment for the agreed amount per month. No more, no less. So the account services rep stated that AMEX would gladly take our account back and work with us on a new payment plan.

Of course, I spoke to Patrick at NCO, 888-217-9861, ext 5024, and he stated that AMEX would not take the account back, and whomever I was talking to did not have the power to make that decision. He advised that I call and attorney and “get educated” on the law in regards to collections, and that AMEX will sue me in a heartbeat. Why am I being sued if I am paying?

AMEX was very helpful with growing my company, and I appreciate it, but being sued by a collector will hurt my wife and I’s personal credit, and limit my business further from being able to ever repay our debt to AMEX. I have paid about 110K over 6 months, I think that proves that I am really trying to get this thing put behind us. I just need a little help here before things spiral out of control.

Mr. Paisola,
I lost my job in January and unfortunatelyu am going through a divorce. I owe 7k to american express which is now 120 days past due. I was a loyal customer for 7 years. As of today, they called my future ex-wife's parents house and threatened to file criminal charges against her and me. My wife has her own american express account. Over a year ago, I added her as a supplemental card holder but we decided never to activate or use the card and I threw the card away(can she be held responsible?)-she also called american express at the e and said she wanted off that account(this was when it was in good standing and we were married).

Is there anything I can do?"I'm trying everything to get a good job to pay it off. should I call them? I've yet to contact them

Nationwide Credit Continues the tradition of Victimizing the Innocent for American Express, Robert Paisola Reports

Hi Robert --

I have read your articles today regarding the harassment that Nationwide Credit & Amex are doing -- I am a victim of just that. I would love to share my story with you. Today marks about the 2nd month of harassment from these people and they call all hours of the day and night and they are all from India. I finally got thru to the headquarters in Georgia today and asked to have my situation moved to an American because I couldn't understand these people from India.

The girl acted very impatient and said that files couldn't be transferred. I told her that I felt like they could and that if they truly wanted to resolve this issue with me that they would honor my request. She promptly transferred me to a girl named "Cricket" where I had to leave a voicemail.

I feel certain I will not hear back from her. While on the phone with the people from India, they made sure that they spoke so quickly that I couldn't understand them, I offered to settle and the man said he would have to consult with his manager -- the manager gets on the phone and again speaks in such a thick accent that I have a hard time understanding him.

He makes remarks threatening a judgement against us and that if we cannot pay the full amount then we certainly couldn't afford to pay the attorneys fees and court costs when it goes to court. He accused me of trying to get out of paying a debt and wouldn't even listen to what I had to say.

I ended up hanging up on him. When I called back a few minutes later, I asked for someone in the US. I was put thru to these same people again and this "manager" told me that I had no business asking for someone in the US. He said that my account was being handled in India. I said that I couldn't understand them -- he laughed and said well since you are not willing to pay your account do not ever call this number again.

We'll just move forward with a judgement against you -- and hung up the phone.

I tried to call AMEX and couldn't get thru. What's next? Thanks!

Allied Interstate for American Express- A Class Action Suit Waiting to Happen, By Robert Paisola

Dear Mr. Robert Paisola,

My husband and I have about 20K of debt on our personal American Express card from a Business franchise that we bought that went out of business. We have managed to talk with our other creditors and set up payment plans and lower interest rates. American Express refused to work with us and we have been making payments for the past year (the account is closed) to try and get the balance down which is virtually impossible at a 30% interest rate.

We had been making payments but have fallen behind with Amex and are now at approximately 50 days past due. We tried to contact Amex again but they have already turned it over to the collector (Allied in Ohio). We have been receiving phone calls on both our home and cell phones, they have also started calling other family members in other states. (We have been through this with them once before when our business first closed and we had our company Amex to pay).

My husband talked to the collector this morning and tried to work with him. The collector proceeded to call my husband a “liar” and said that we have the money to pay for this debt! We do not have the money to pay up front, he said that he was looking at a credit card we have with $6,000 free on it and he wanted that plus payments every month for 6 months and then the rest of the balance at the end of the 6 months. This is ridiculous, for one, we have closed ALL our credit cards and are in the process of paying them all back, secondly, we have repeatedly tried to get Amex to work with us to pay it off. The Collector finished the call by telling us that he is going to Amex to tell them that we will not cooperate and they will be suing us.

American Express and Nationwide Credit- Pure Hell on Earth, Posted by Robert Paisola

Yesterday I contacted American Express in regards to a card that had gone unpaid, I was looking to keep the account from falling into default but was unable to do so since I was informed that Amex had forwarded the account to Nationwide Credit just the day before I had contacted them.

I followed up my call to Amex by contacting Nationwide Credit, they had never contacted me I just thought it would show my intent to make good on my debt if I went ahead and called them first.

That is when my experience became very similar to the call that you have posted on your website, which is what compelled me to join the VIP’s and contact you.
A gentleman named Kenny Clayton (888) 322-2608 x-5004 informed me that I had to pay the entire amount of my account totaling $33,000, I told him that that was an impossible amount for me to come up with.

He told me that the only other payment arrangement would be to pay half up front which exceeded $15,000 and then make payments over the following two months that would total more than $7,000 each and that those were the only two options that Amex gives for accounts that go into default.

I told Mr. Clayton that I wanted to settle my debt but that neither one of those options was realistic he told me there was no other option.

He brought up my FICO score which has dropped from above 700 to around 585 due to this and asked me if this was the first time that I had ever had an account fall into collections…I confirmed that in fact it was the first time this had happened; and he said he thought so because my score was still that high.

Mr. Clayton then suggested that I apply for another credit card and make a balance transfer, apply for a loan at my bank, pull money out of my equity or get the money from family or friends and after putting me on hold to check with his supervisor gave me 48 hours to try and procure the money; that deadline expires tomorrow-Friday February 8 @ 9AM.

Obviously distraught because I knew there was no way that I could make this happen I started doing some searches on the internet which is where I found your website and listened to the phone call posted there.

The delinquency on this account has occurred as a result of the Southern California Wildfires at the end of October 2007.

I own my own seafood market in Ventura County and while my business was not directly damaged the impact the fires had as a result of evacuations and blackouts was devastating on my business where over a three – four week period from late October to mid-November we lost about 70% of our regular business.

During this difficult time pretty much everyone was helpful in aiding us getting back on our feet except for American Express which provided us absolutely nothing in the way of help and immediately started the delinquent notices piling up on the account.

At this point I have absolutely no idea how to approach tomorrow morning and with trying to run a business I don’t have the time to go through and figure out what the laws are governing these agencies, please help me; I am willing to repay my debt but Nationwide Credit has put the fear in me that if I don’t come up with $33,000 that they will pursue me through other means.
